Where was “the Juice” at 10:03 in the evening on June 12th 1994, the same night Nicole Brown Simpson and Ronald Goldman were brutally murdered, their throats slashed?.  The two crumpled bodies were discovered in a pool of blood on the front steps of Ms. Brown’s Brentwood condo on the West Side of Los Angeles, CA. Most of the story is so well known, so detailed, so sensationalized we don’t need to repeat much more about the most notorious murder case in recent American history. The "Trial of the Century" as it came to be known is an old story to most.  But as a still "unsolved" double homicide case, ERSNews believes the story and the case should always warrant further investigation.

We all know the story: former USC Heisman Trophy winner and NFL Hall of Fame football player and actor/celebrity pitchman OJ Simpson was charged with the brutal murder of Nicole Brown Simpson and Ronald Goldman.  Simpson was ultimately found not guilty of the crime in 1995. Later in 1997 Simpson was found liable for the wrongful death of Brown-Simpson and Goldman in a separate civil suit and ordered to pay over 33-million dollars in damages in that case to the victim's families, most of which has never been paid.  California law protects Simpson’s N-F-L pension to satisfy a judgment and Simpson has been able to continue much of his life style based on that pension, now living in Florida.

ERSNews has uncovered exclusively that one piece of crucial evidence which may have altered the course of both the criminal and civil case, was never properly examined and never properly turned over to authorities.  The crucial information was not used in either the criminal or civil cases against Simpson or provided to anyone thereafter since the night of the murders on June 12th 1994.

The facts uncovered by ERSNews are shocking, but more importantly could have and still could provide indisputable evidence as to the exact whereabouts of OJ Simpson at 10:03PM on the night the murders of Nicole Brown and Ronald Goldman.

Mr. Simpson’s account about where he was at 10:03PM on June 12th 1994 has changed more than once.  First, he told the police shortly after the murders, that he was driving around in his Bronco using his cell phone.  Later, in the civil case, he testified that he was at his Rockingham Estate chipping golf balls and using his cell phone.

The true story about where Mr. Simpson was that evening of June 12th 1994 at 10:03P when he placed two cellular phone calls to his then girlfriend Paula Barbieri, should have and still could be determined by authorities and cellular telephone engineers and experts.

The problem is that it never was and never has been to date.

Exclusively obtained internal records from the Los Angeles District Attorneys office, including the actual subpoena seeking to determine the location of Mr. Simpson’s cell phone that evening when he made the calls in question and the legal response back from Simpson’s cell phone carrier at the time AirTouch, have never been seen publicly before until now. (note: AirTouch Cellular ultimately was incorporated into what is now known as Verizon Wireless)

What the exclusively obtained records show and additional extensive investigative reporting by ERSNews has uncovered is that the Los Angeles District Attorney in a subpoena dated only five days after the double murder sought to discover the location of Mr. Simpson’s cellular phone when the 10:03PM calls where placed on June 12th 1994 by Mr. Simpson.  The subpoena to AirTouch Cellular  specifically asked for "the location of the cellular unit when the calls where made." Simpson’s cellular phone company never turned over this crucial and potentially case altering information to the District Attorney, only giving the LA-DA a generic map of the Brentwood cell site as it existed the night of the murders.

When AirTouch failed to provide the accurate and complete information the LA-DA’s office, led by then lead prosecutor Marcia Clark, in turn never followed up and sought the correct and accurate information demanded.

Multiple cellular industry experts and sources have told ERSNews that the information was available at the time the subpoena was issued on June 17th 1994 just 5 days after the murders.  The information according to ERSNews sources could still be available today.

The information, if properly provided and analyzed by experts in cellular location technology, would have allowed those experts and ultimately law enforcement, the District Attorney and others to pinpoint Simpson’s exact location geographically to within less than 50 feet of the location where the cellular phone was in Los Angeles at the time the calls were placed.

Mr. Simpson has never disputed he made the calls, as he left his then girlfriend Paula Barbieri an answering machine voice mail during one of the 10:03PM calls.

Proof of the calls is detailed in Simpson’s own cellular phone records obtained by ERSNews.

This crucial evidence would have and still could provide the most direct evidence as to where Mr. Simpson was at that precise time, on the night of the murders.  Potentially placing him at or near the scene of the murders or providing proof backing up where he may have been at the time.

When ERSNews learned of this information, and pursued it, lead DA-prosecutor in the Simpson criminal case Marcia Clark, declined to comment or even discuss the issue. The Enterprise Report has still not been unable to determine why this crucial evidence was never followed up by the LA District Attorney's office. William J Hodgeman, one of the LA-DA’s lead prosecutors on the Simpson case did speak with ERSNews about this evidence and handled the release of the exclusively obtained DA records under the California Public Records Act.

ERSNews also spoke with former lead Simpson case LAPD Detective Tom Lange who expressed his opinion that the evidence should have been obtained if it was available and that any failure to do so, would have been the responsibility of the DA’s office.  Lange told ERSNews that he became somewhat familiar with cellular tracking technology during the infamous slow speed chase where OJ Simpson was ultimately apprehended.  Similar technology was used to track Simpson as he drove throughout Southern California and the Los Angeles area before returning to his Brentwood mansion.

Just prior to publication of this story, ERSNews once again attempted to reach the major players in the Simpson case, but was unable to reach anyone involved in the criminal or civil cases directly, including Mr. Simpson himself, his attorneys, or other members of the Brown and Goldman families. None returned our calls seeking comment.
